Family Class Sponsorship in Canada

What are the responsibilities of a sponsor?

When you agree to become a sponsor, you sign an agreement called a Sponsorship Agreement with Immigration, Refugees and Citizenship Canada (IRCC). This agreement says you will financially support the sponsored person for a certain period of time after they arrive in Canada. You must ensure the individual has their basic needs met, including things like housing, food, and clothing, or the money to pay for them.

If the person you sponsored as a permanent resident gets social assistance during the time you agreed to be financially responsible for them, you must pay that money back to the government. Sponsors remain obligated to this Agreement for the term of the contract, even if a change of circumstances occurs, like a marital breakdown or a change in financial circumstances.

 Sponsor your spouse, partner, or dependent children  

Canada recognizes three categories of relationships as valid for spousal sponsorship:

  1. Spousal sponsorship: Your spouse must be legally married to you and at least 18 years old. If the marriage took place outside of Canada, it must be valid under Canadian law. A valid marriage certificate is required.
  2. Common-law partner sponsorship: Your common-law partner must be at least 18 years old not legally married to you. You must be living together continuously for 12 months, while in a committed relationship.
  3. Conjugal partner sponsorship: Your conjugal partner must be at least 18 years old and not legally married or in a common-law relationship with you. You must be in a romantic relationship for at least a year and are unable to live together because of significant legal and immigration reasons.

Children qualify as dependents if they meet both of these requirements:

  • they are under the age of 22
  • they do not have a spouse or common-law partner

Children over the age of 22 may still qualify as dependents if they meet both of these requirements:

  • they have depended on their parent for financial support since before the age of 22
  • ​​​​they are financially dependent on a parent due to a physical or mental condition

Sponsor your parents and grandparents

You can sponsor your own parents or grandparents who are related by blood or adoption. In case of divorce or separation, you can also sponsor your parents’ and your grandparents’ spouses, or conjugal or common-law partners.

​​​​​​​You cannot sponsor:

  • your spouse’s parents and grandparents (your in-laws)
  • someone who is criminally or medically inadmissible to Canada
