Work permits in Canada

Work permits are generally required for foreign workers who would like to work in Canada on a temporary basis. There are specific requirements you need to meet depending on if you apply from outside Canada, inside Canada or at the port of entry.

Types of work permits

There are two types of work permits in Canada: open work permits and employer-specific work permits.

1. OPEN WORK PERMITS

An open work permit is not tied to a single occupation, employer or location. Open work permits are commonly issued through the following immigration programs:

  • Bridging Open Work Permits (BOWP)
  • Post-Graduation Work Permits (PGWP)
  • International Experience Canada (IEC)
  • Inland Spousal or Common-Law Sponsorship

2. EMPLOYER-SPECIFIC WORK PERMITS

An employer-specific work permit allows you to work according to the conditions or limitations on the work permit. This type of work permit is tied to a specific employer, location or timeframe.

Before you submit your application for temporary residence, your employer must complete certain steps and provide you with a copy of a positive Labour Market Impact Assessment (LMIA) letter or an offer of employment.

An LMIA is a document that a Canadian employer needs to get before hiring a foreign worker. It shows that there is a need for a foreign worker to fill the job and the employer was not able to find a Canadian worker or permanent resident for that specific job.

In some cases, an employer can hire a temporary foreign worker without an LMIA. LMIA-exemptions are available for specific categories of workers, through certain immigration programs, and international agreements between Canada and other countries.

Lawyers at Khan Law handle all types of work permits and applications for temporary workers, business people, students and caregivers in the Live-In Caregiver Program.
